Alex Hirsch calls Bank Of America
Credit Card Scavenger?
I had a credit card from bank of america which had 2000$ charged to it. With all the interest rates jacked up and the overlimit fees I was in a never ending cycle. I stopped paying on it, it went into what I call 2nd party collections and now BoA wrote the card off (They told me on the phone). Now I have some scum bag calling me on my cell phone while I am at work saying hes some paralegal in NY, and they are going to file arbitration papers yada yada yada. For the FULL amount the amount charged plus all the interest and late fees which total 2,688$. He even began to bash my job. I told him I dont have time as I am the manager on duty at my work place, He then told me “Well how busy can a Gamestop be, I have a 360, then told me not to lie to him” Asked to speak to my manager, but I am my own manager. Scavenger? and should I be worried? I mean people have like thousands upon thousands I have only 2k.
Well the “paralegal” has made a couple violations against the law. Legal threats, personal attacks, and contact by cell, just to name a few. You need to get yourself informed NOW of the FDCPA (fair debt collection practices act)!
How old is this debt? Is this debt within your state’s statute of limitations? Have you received any written communication from the Collection agency (CA)? Who is the CA? Are they reporting on your credit report? If so, How are the reporting (minus personally identifiable information IE account number)?
You need to send the CA a request for proof of this debt; mailing certified mail return receipt requested immediately. You are intitled to a full accounting of all monies their alleging you owe. It’s obvious by the violations already made they are more than willing to make more. I suggest staying off the phone with them if at all possible. If it’s not possible to screen your calls ; record the calls if it is legal to do so in your state.
Was this their first communication with you? If so, they have 5 days from first contact to submit communication in writing or that is an additional violation.
These violations are sueable in court for a max of 1K.
Just because you only owe 2K doesn’t mean they won’t try to sue. I have seen CA’s sue for as little as $100. They’ve already made some crucial errors that if they did try to file, once you know the FDCPA and KNOW for yourself which laws were violated, you could file a countersuit for their blatent disregard to the law.
